Disability and Estate Planning

Estate planning is about peace of mind. You want to know that your spouse and kids will be taken care of. You want to make sure your family does not have to deal with unnecessary stress and expenses. Planning for your death or disability can be unpleasant, but it can also save you and your family quite a bit of money.  Whether it’s a simple will or a more detailed estate plan, I will work closely with you to ensure that you achieve your goals.
 

Service Packages - Disability and Estate Planning

 

The fixed-fee prices listed on this website do not constitute an offer to provide any service at the price shown, or at any other price.

 

The listed prices are base prices for the particular type of service. I reserve the right to set a higher fixed-fee price if the particular matter is likely to require more work than usual based on my evaluation of the particular facts and circumstances. Prices are subject to change.

Single Estate Plan Service Package: $300

This service package includes:

  • Will. A will allows you to specify who receives your property after your death and who will handle the affairs of your estate. Your will is tailored to your specific desires and needs.

  • Durable Power of Attorney. A durable power of attorney allows your designee to manage your affairs if you are unable to do so.

  • Oregon Advance Directive. Guidance completing this state-mandated form for appointing a health care representative and giving instructions on your medical care if you are unable to do so.

  • Appointment of Person to Make Decisions Concerning Disposition of Remains. Guidance completing this state-mandated form for ensuring your wishes for burial or cremation are followed.

 

Single Will Service Package: $200

A will allows you to specify who receives your property after your death and who will handle the affairs of your estate. Your will is tailored to your specific desires and needs.

Single Durable Power of Attorney Service Package: $100

A durable power of attorney allows your designee to manage your affairs if you are unable to do so. In the right circumstances, a POA could save you considerable money on establishing a guardianship or conservatorship for a disabled adult.

Couples* Estate Plan Service Package: $500

This service package includes, for both spouses:

  • Will. A will allows you to specify who receives your property after your death and who will handle the affairs of your estate. Your will is tailored to your specific desires and needs.

  • Durable Power of Attorney. A durable power of attorney allows your designee to manage your affairs if you are unable to do so.

  • Oregon Advance Directive. Guidance completing this state-mandated form for appointing a health care representative and giving instructions on your medical care if you are unable to do so.

  • Appointment of Person to Make Decisions Concerning Disposition of Remains. Guidance completing this state-mandated form for ensuring your wishes for burial or cremation are followed.

 

*For legal reasons, the Couples Estate Plan SP is limited to two persons who are legally married to one another. If you have a “partner” or partners, and you are not legally married, alternative arrangements are possible to achieve your estate planning goals. I will waive the consultation fee for any such inquiry (specify “non-traditional estate planning” in your message).

Transfer on Death Deed Service Package: $150

A transfer on death deed allows you to automatically pass title to real property on your death to the person(s) you designate. In the right circumstances, it can save you quite a bit of money (eg, if it allows you to avoid a probate procedure).

Family Trust*: $1,500-2,000

A family trust is an incredibly flexible and efficient legal tool that allows you to plan for your disability and death. Its most significant advantage is that it can save you quite a bit of money and time by avoiding a probate procedure (or two) and other unnecessary legal costs. It also keeps your affairs private (no court filings) and allows for continued care of loved ones (eg, children or elders) after your death.

 

The Family Trust SP includes everything in the Single and Couple Estate Plan SPs (see above), as well as the trust instrument and associated documents, and any deeds necessary to transfer real property to the trust. The price varies based on the amount of work involved in the particular trust.

* The Family Trust SP is only for estates not subject to Oregon or federal estate transfer tax. As of January 2020, Oregon estates worth $1 million or more are subject to the state estate transfer tax. If you have an estate subject to the estate transfer tax (as valued at your death), I can provide a referral to another attorney to prepare a trust that meets your needs.

Trust and Estate Administration

Trust and estate administration can be complicated. You have taxes and bills to pay, out-of-pocket expenses, reports to write, and beneficiaries to satisfy.  I will guide personal representatives (formerly called “executors”) and trustees through the process of administering and closing an estate or trust fairly and efficiently.

Probate Service Package: $1,500-2,000

Probate is a court process by which the assets of a deceased person are legally transferred to the recipients after taxes and other expenses are paid. The price varies based on the amount of work involved in the particular estate.

 

Fixed-fee price quotes are available by consultation, which you can schedule here. If I am hired to handle the probate after a consultation, I will credit the $50 consultation fee toward the quoted price.

Trust Distribution and Closing Service Package: $800-1,200

After the death of a trust-maker, a successor trustee must carry out the trust-maker’s wishes by paying taxes and expenses, transferring the property to the designated recipients, and closing the trust. The price of this SP varies based on the amount of work involved in the particular trust.

 

Fixed-fee price quotes are available by consultation, which you can schedule here. If I am hired to handle the trust closing after a consultation, I will credit the $50 consultation fee toward the quoted price.

Establish a Conservatorship or Adult Guardianship Service Package: $1,000

When people become unable to care for themselves, Oregon’s courts will allow someone to be appointed to handle the disabled person’s financial affairs (called a “conservatorship”) and/or their personal care (called a “guardianship”). Unfortunately, the rising rates of dementia in our society are making conservatorships and guardianships of disabled adults increasingly common. When legally appropriate, I can guide you through the process of establishing a guardianship and/or conservatorship for a disabled adult family member. This service package includes the court filing fee, appearance at the initial hearing, and any further work necessary after establishing the guardianship or conservatorship done at the discounted hourly rate of $200. It does not include any bond required by the court.
